Event attendee terms and conditions

These terms and conditions (the “Attendee Terms”) apply to delegate registrations for all events and conferences, whether in-person or virtual, (each an “Event”) organized by TM Forum, A New Jersey non-profit corporation (“TM Forum”). Please read them carefully as they contain important information. By submitting your registration, you, your employees, agents, and contractors, and any other entity or person on whose behalf you register (collectively "You" or the “Attendee”) agree to be bound by these Attendee Terms, which, together with the registration request and any terms applicable to the registration process and referenced herein constitutes the “Agreement” between the parties.
1. Registration requests: All registration requests are subject to acceptance by TM Forum, which will be confirmed in writing to You by email. TM Forum reserves the right to refuse to accept or reject any registration request. You must ensure that all entries, including a valid email address, are entered correctly on the registration form or promptly corrected by written notice to TM Forum. You will receive essential information for the Event attendance electronically at the email address provided through the registration form. Be sure to check the spam folder of Your email inbox for any Event email(s) caught by spam filters.
2. Payment; Right to change prices
2.1. TM Forum accepts payment by bank transfer (net 30 days) or credit card (Visa, MasterCard, or American Express).
2.2. Payment for the Event must be received in full by TM Forum in accordance with TM Forum’s payment terms provided at the point of registration. If TM Forum does not receive payment in full before the Event, TM Forum reserves the right, in its sole discretion and without liability, either to require payment as a condition of entry to the Event or to refuse entry to the Event. TM Forum will make no refunds of any portion of fees already paid (if any), and any balance of the fees will remain due and payable where entry to an Event is refused under this section.
2.3. TM Forum reserves the right to change the Event attendance prices at any time, but changes will not affect registrations already confirmed by TM Forum.
3. Discounts: Discounts for group registrations are only valid for the number of Attendees specified. If the number of Attendees is less than the number specified in the group booking (either as a result of cancellations prior to the Event or as a result of Attendees failing to attend the Event), TM Forum reserves the right in its sole discretion to revise the fees in line with the number of Attendees actually attending the Event in accordance with TM Forum’s published prices then in force and require payment of such fees in accordance with the terms of these Attendee Terms and the payment terms provided at the point of registration.
4. Event access; Registration transfers.
4.1. Your confirmed registration entitles You to access the Event on an in-person or virtual basis, as the case may be. You must visibly wear a badge at all times while attending an in-person Event.
4.2. Registration transfers (i) must be approved by TM Forum, and (ii) will incur a $75 fee if requested within thirty (30) days of the Event or onsite (excludes Catalyst and Exhibitor passes).
4.3. Attendees (i) are prohibited from selling or transferring registrations to third parties without prior approval from TM Forum, and (ii) must keep credentials confidential.
4.4. Violations may result in (i) access cancellation, (ii) payment retention, and/or (iii) a ban from future events
5. Termination.
5.1. TM Forum may terminate this Agreement with immediate effect in the event You commit any material breach of this Agreement.
5.2. Upon any cancellation of the Event or termination of this Agreement, the following Sections of these Terms and Conditions shall survive: 2, 7, 11, and 13.
6. Cancellation policy and cancellation charges.
6.1. More than 31 Days Before the Event: If You cancel more than 31 days before the Event, 50% of the fees will be refunded.
6.2. Within 31 Days of the Event or No-Shows: No refund will be provided if You cancel within 31 days of the Event or do not show up. The Cancellation Charges are TM Forum’s sole remedy and Your sole obligation in the event of cancellation.
6.3. All Cancellation Charges are due immediately upon cancellation. These charges represent liquidated damages, not penalties, as actual damages would be difficult to calculate. The charges compensate TM Forum for reserving the attendance spot and associated administrative costs.
7. Force Majeure.
7.1. Definition: A “Force Majeure Event” includes any event beyond the reasonable control of TM Forum, whether foreseeable or unforeseeable, such as speaker or participant cancellations, strikes, natural disasters, epidemics, pandemics, government restrictions, or any other circumstances making the holding of the Event impracticable or impossible.
7.2. In the event of Force Majeure: If TM Forum cancels the Event due to such an event, Attendees may request credit toward future TM Forum products or services for use within the same calendar year. The credit amount will be calculated after deducting TM Forum's non-recoverable costs and expenses related to the Event, and TM Forum will provide a written explanation of any credit limitations.
7.3. Liability: TM Forum shall not be liable for any loss, delay, damage, or other liability incurred resulting from or arising in connection with the cancellation, rescheduling, reformatting, or venue change of the Event due to a Force Majeure Event. The Attendee acknowledges that the limitation on credit in case of cancellation of the event/workshop due to a Force Majeure Event is reasonable, and that TM Forum, at its sole discretion, when issuing credit, may take into account its ability to do so based on its financial standing, the impact thereof on the best allocation to spend membership funds, and any insurance claim or payment to the Attendee or on its behalf or TM Forum for respective losses. TM Forum will take reasonable steps to mitigate the impact of a Force Majeure Event.
8. Event modifications.
8.1. TM Forum reserves the right at any time to change the format, speakers, participants, content, location, and timing, or any other aspect of the Event for any reason, whether or not due to a Force Majeure Event, in each case without liability.
8.2. Where TM Forum reschedules, reformats, or cancels the Event (and the Attendee no longer wishes to attend the rescheduled Event) for any reason except due to a Force Majeure Event, the Attendee will be entitled to receive a credit note for use during the same calendar year.
8.3. The provisions set forth in this section shall constitute the Attendee's sole and exclusive remedy for any cancellation, rescheduling, or reformatting of the Event by TM Forum. 9. Attendee Removal. TM Forum may, at its discretion, remove or deny entry to any Attendee who: (1) fails to comply with this Agreement, (2) poses a security risk, (3) disrupts the Event, or (4) hinders the enjoyment of the Event by other attendees. You agree to comply with all reasonable instructions from TM Forum and Event venue personnel.
9. Attendee removal. TM Forum may, at its discretion, remove or deny entry to any Attendee who: (1) fails to comply with this Agreement, (2) poses a security risk, (3) disrupts the Event, or (4) hinders the enjoyment of the Event by other attendees. You agree to comply with all reasonable instructions from TM Forum and Event venue personnel.
10. Recordings and photographs.
10.1. By attending the Event, You grant TM Forum a perpetual, worldwide right to record, photograph, and film You, and to use, edit, and to distribute such content for any purpose without further approval or compensation. This includes the right to allow others to use and distribute the content.
10.2. TM Forum may record the Event content and make it accessible to others.
10.3. Unauthorized photography, audio recording, or video recording is prohibited at the Event.
11. Personal data.
11.1. Your personal data (including email address, name, company, job title, phone number, and location) may be shared with Event sponsors in the following circumstances:
11.1.1. When participating in online activities, including invite-only sessions, sponsored content sessions, demos, and participant interactions.
11.1.2. When attending sponsored in-person activities, such as Digital Leadership Summits and Lunch Briefings.
11.1.3. When Your attendee badge is scanned at sponsored activities, demonstrations, or exhibitor booths.
11.2. All personal information will be processed according to TM Forum’s privacy policy. Where required by law, Your consent will be obtained before sponsors use Your data for direct marketing purposes.
11.3. If a third party registers an Attendee on their behalf, such third party is responsible for obtaining the Attendee’s consent to process their personal data in accordance with this Agreement and TM Forum’s privacy policy before initiating a registration.
11.4 TM Forum may offer optional event features powered by a third‑party platform, Premagic. Where an individual chooses to participate in these features, Premagic may process biometric data, including facial recognition data, for the purpose of distributing event photographs and related optional promotional or advocacy materials. Such biometric data processing is carried out solely by Premagic, acting independently, and is based exclusively on the individual’s separate, explicit consent obtained directly through Premagic’s own consent flow and privacy notice. TM Forum does not receive or process biometric data in connection with these features. Participation in Premagic‑powered features, including photo delivery and related materials, is entirely voluntary and separate from event registration. Individuals may decline to participate or withdraw their consent at any time, without any impact on their ability to register for, access, or attend the event.
12. Complimentary event WiFi.
12.1. TM Forum provides complimentary wireless Internet access in designated areas. By using this service, You agree to use it legally and responsibly, comply with all applicable laws and regulations, and consent to share Your contact information (email, name, company, job title, phone number, and location) with the Wi-Fi sponsor.
12.2. You may not use the wireless network to:
12.2.1. Engage in any criminal activity;
12.2.2. Attempt unauthorized access to any computer systems;
12.2.3. Generate or send spam or chain letters;
12.2.4. Transmit unlawful, harassing, or threatening content;
12.2.5. Generate, transmit or store offensive, sexually explicit, or discriminatory material;
12.2.6. Access inappropriate websites;
12.2.7. Download non-business files or large files (>50MB) without prior approval
12.3. You acknowledge that wireless Internet access is inherently insecure. TM Forum provides wireless connectivity in the Event facility as a guest service without any guarantees of security or privacy. Use of the wireless network is at your own risk, and any information transmitted may be intercepted by other users. Users should not transmit sensitive information (including credit card details, passwords, or personal data) while using the network. Users agree to hold harmless TM Forum and its employees for any data loss, compromise, hardware damage, or security issues.
13. Limitations of liability; Disclaimer of warranties
13.1. General Liability. TM Forum and the Event venue (hosting hotel, convention center, platform, or other venue) will not be liable for loss or damage to Your goods or properties. Such goods and properties remain in Your sole possession, custody, and control at all times. Attendance at the Event is at Your own risk, and TM Forum is not liable for any actions, omissions, or negligence by You or Your associates.
13.2. DISCLAIMER OF WARRANTIES. THE EVENT AND EVENT ATTENDANCE ARE PROVIDED “AS IS” WITHOUT ANY WARRANTY OF ANY KIND. TM FORUM DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, TITLE, NON-INFRINGEMENT, AND FITNESS FOR A PARTICULAR PURPOSE. YOU ACKNOWLEDGE THAT YOUR AGREEMENT TO THESE TERMS IS NOT BASED ON ANY REPRESENTATION NOT EXPRESSLY MADE HEREIN.
13.3. LIMITATION OF LIABILITY. TO THE EXTENT PERMISSIBLE UNDER APPLICABLE LAW, TM FORUM’S AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS OR SUITS OF ANY KIND ARISING OUT OF OR RELATED TO THIS AGREEMENT, WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), WARRANTY, STRICT LIABILITY, OR OTHERWISE, WILL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO TM FORUM UNDER THIS AGREEMENT. TM FORUM SHALL NOT BE LIABLE FOR ANY SPECIAL, INDIRECT, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES. ANY CLAIM OR ACTION AGAINST TM FORUM MUST BE FILED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES OR SUCH CLAIM SHALL BE FOREVER BARRED, EXCEPT WHERE PROHIBITED BY APPLICABLE LAW. THESE LIMITATIONS OF LIABILITY DO NOT APPLY TO: (I) TM FORUM'S GROSS NEGLIGENCE OR WILLFUL MISCONDUCT; (II) DEATH OR PERSONAL INJURY CAUSED BY TM FORUM'S NEGLIGENCE; OR (III) ANY OTHER LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
13.4. Virtual Event Disclaimer. TM Forum has contracted with third parties to provide high-quality virtual experiences. However, TM Forum does not guarantee that a virtual Event will operate without interruptions or malfunctions. TM Forum gives no assurances or guarantees about the availability, quality, operation, or support services for data traffic on the networks or lines of the Attendee’s internet provider. TM Forum shall not be liable for any interruption, partial restriction, or inaccessibility of a virtual Event, whether in whole or in part, due to events beyond TM Forum’s reasonable control, even if theoretically preventable.
14. Miscellaneous
14.1. Entire agreement. This Agreement constitutes the sole and entire agreement between the parties with respect to the matters set forth herein and related hereto and supersedes and incorporates any and all prior or oral and/or written statements and representations on such matters by either of the parties hereto.
14.2. Assignment. TM Forum may assign or delegate this Agreement or any of its obligations or rights herein to a TM Forum affiliate, subsidiary, or successor.
14.3. Modifications to the Attendee Terms. TM Forum may revise or update these Attendee 5 2 Terms from time to time in TM Forum’s sole discretion, without prior written notice to the Attendee. All amendments shall be effective immediately upon being published on the TM Forum website or otherwise made available to the Attendee. TM Forum will make reasonable efforts to notify Attendees of material changes to these terms via email. For Events already scheduled, the version of the terms in effect at the time of registration shall govern unless the changes are required by law or are beneficial to the Attendee. The Attendee agrees that it is the Attendee’s responsibility to consult the TM Forum website to obtain the current Attendee Terms. The Attendee’s continued use of TM Forum services or attendance at the Event, or performance under this Agreement constitutes the Attendee Terms.
14.4. Severability. Should a court of competent jurisdiction declare any portion of this Agreement invalid or unenforceable, the remaining portions of this Agreement not invalidated shall govern and bind the parties and be construed as if the invalidated portions were not originally included in this Agreement.
14.5. Arbitration; Governing law. All disputes arising out of this Agreement that are not disposed of by agreement between the parties hereto will be decided solely by arbitration proceedings under the Rules and Procedures of the American Arbitration Association and such arbitration shall be held in the State of New Jersey, to the fullest extent permitted under applicable law. The parties agree that any decision rendered by the arbitrator as provided herein shall be binding on both parties as though issued by a court that would otherwise have jurisdiction over such issues. The parties agree that this Agreement shall be governed by and interpreted and construed in accordance with the internal substantive laws of the State of New Jersey without regard to its conflicts of laws rules or principles. Notwithstanding the arbitration provision above, either party may seek equitable relief from either a Federal or State Court of New Jersey should the need for equitable relief arise. THE PARTIES EXPRESSLY WAIVE ANY RIGHT TO BRING ANY ACTION, LAWSUIT, OR PROCEEDING AS A CLASS OR COLLECTIVE ACTION, PRIVATE ATTORNEY GENERAL ACTION, OR ANY OTHER PROCEEDING IN WHICH ANY PARTY ACTS OR PROPOSES TO ACT IN A REPRESENTATIVE CAPACITY.
